These Terms and Conditions (“Terms”) govern your access to and use of the digital platform operated by BIMAPAY, a company incorporated under the laws of India, (“Company”, “we”, “us”, or “our”). The platform includes the website located at BimaPay – Easy way to get financing for insurance premiums (the “Platform”).
By accessing, browsing, or using the Platform, You (“User”, “you”, or “your”) acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must refrain from using the Platform.
1. MODIFICATIONS OF TERMS OF USE, SITE OR SERVICES
1.1. The Company reserves the right, at its sole discretion, to modify, amend, update, suspend, or discontinue any part of these Terms, the Platform, or the Services offered therein, at any time and without prior notice.
1.2. Any changes to the Terms shall become effective immediately upon posting on the Platform. Your continued use of the Platform following such changes shall constitute your acceptance of the revised Terms.
1.3. It is your responsibility to periodically review these Terms to stay informed of any updates or modifications.
2. CONTENT
2.1. All content available on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and digital downloads (“Content”), is the property of the Company and is protected under applicable intellectual property laws.
2.2. You may not reproduce, distribute, modify, transmit, reuse, download, repost, copy, or use the Content for commercial purposes without the prior written consent of the Company.
2.3. The Company reserves the right to remove, alter, or restrict access to any Content at its sole discretion.
3. ELIGIBILITY
3.1. You represent and warrant that you are a natural or legal person who is competent to contract under the Indian Contract Act, 1872, and are at least 18 (twenty-one) years of age.
3.2. The Company reserves the right to deny access to the Platform or terminate any account if it is discovered that you are not eligible to contract or have provided false, misleading, or incomplete information.
4. USER SUBMISSIONS
4.1. Any content, feedback, ideas, suggestions, proposals, plans, or other materials submitted by you to the Company, whether solicited or unsolicited (“Submissions”), shall become the property of the Company.
4.2. You grant the Company a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Submissions in any format or medium.
4.3. You represent that your Submissions do not infringe upon any third-party rights and do not contain unlawful, defamatory, or malicious content.
5. PROHIBITED ACTIONS
5.1. You agree not to engage in any activity that is unlawful, unauthorized, or otherwise prohibited under these Terms, including but not limited to:
∙ Accessing the Platform through unauthorized means;
∙ Transmitting viruses, malware, or harmful code;
∙ Harvesting or collecting personal data of other Users;
∙ Impersonating any person or entity;
∙ Violating intellectual property rights;
∙ Engaging in fraudulent, abusive, or deceptive conduct;
∙ Circumventing security features or access controls;
∙ Using automated tools to extract data from the Platform.
5.2. The Company reserves the right to suspend or terminate your access to the Platform, along with mandated legal action, for any violation of this clause.
6. LINKS TO THIRD-PARTY SITES
6.1. The Platform may contain links to third-party websites or applications. These links are provided solely for your convenience and do not constitute an endorsement or recommendation by the Company.
6.2. The Company does not control and is not responsible for the content, accuracy, legality, or reliability of any third-party sites.
6.3. Your interaction with any third-party site is governed by the terms and policies of that site, and the Company shall bear no liability in this regard.
7. WARRANTIES AND DISCLAIMERS
7.1. The Platform and Services are provided on an “as is” and “as available” basis. The Company disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.2. The Company does not warrant that:
∙ The Platform will meet your requirements;
∙ The Platform will be uninterrupted, timely, secure, or error-free;
∙ Any errors or defects will be corrected.
7.3. You acknowledge that any material downloaded or obtained through the Platform is done at your own risk, and you shall be solely responsible for any damage to your device or loss of data.
8. LIMITATION OF LIABILITY
8.1. To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with:
∙ Your use of or inability to use the Platform;
∙ Unauthorized access to or alteration of your data;
∙ Any third-party conduct on the Platform;
∙ Any other matter relating to the Platform.
8.2. In any event, the Company’s total liability shall be limited to the amount actually paid by you to the Company for the specific Service giving rise to the claim.
9. SEVERABILITY
9.1. If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be severed from the Terms, and the remaining provisions shall remain in full force and effect.
10. LIMITATIONS OF CLAIMS
10.1. Any claim or cause of action arising out of or related to the use of the Platform or these Terms must be filed within Six (6) months after such claim or cause of action arose, failing which it shall be permanently barred.
11. GOVERNING LAW AND JURISDICTION
11.1. These Terms shall be governed by and construed in accordance with the laws of India.
11.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India and the language shall be English.
12. GENERAL
12.1. These Terms constitute the entire agreement between you and the Company with respect to the Platform.
12.2. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. The Company’s failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
13. GRIEVANCE REDRESSAL
13.1. In accordance with applicable laws, including but not limited to the Information Technology Act, 2000 and the rules framed thereunder, BimaPay (“Company”) has designated a Grievance Officer to address complaints, concerns, or grievances raised by Users in relation to the use of the Platform, the Services, or any content therein.
13.2. Any User who has a grievance, concern, or complaint regarding the Platform, including but not limited to issues relating to content, data handling, privacy, or service delivery, may submit such grievance in writing to the designated Grievance Officer at the following contact details:

13.3. The Company shall make best efforts to acknowledge and respond to the grievance within 28 working days from the date of receipt. Resolution timelines may vary depending on the nature and complexity of the grievance.
